Information regarding the conclusion of the Agreement on Conformity Assessment and Acceptance of Industrial Products (Agreement on Conformity Assessment and Acceptance of Industrial Products, АСАА Agreement, “Industrial visa-free”)

The aim of conclusion of the АСАА Agreement: to open the access of industrial products to the markets of Ukraine and the EU countries on the basis of mutual recognition of the results of conformity assessment works for these products.

Priority sectors of industrial products for conclusion of the АСАА Agreement:

  • low-voltage electrical equipment;
  • electromagnetic compatibility of equipment;
  • machinery.

Contents of the ACAA Agreement:

  • requirements of Ukrainian technical regulations for products are identical to the requirements of the corresponding EU Directives;
  • standards, which provide a presumption of compliance with the requirements of technical regulations, and their lists are identical to the corresponding European harmonized standards and their lists;
  • requirements for designated bodies are identical to the requirements for notified bodies in the EU;
  • Ukrainian manufacturers will have the right to affix the European CE mark of conformity to their products.

Prospects of the ACAA Agreement:

  • possibility of extension to other sectors of industrial products listed in the Appendix III of the Ukraine – EU Association Agreement;
  • inclusion of other sectors of industrial products, which are priority for the Parties, in the ACAA Agreement.

What was done for conclusion of the ACAA Agreement:

  •  The following Laws of Ukraine were adopted:
  • “On Metrology and Metrological Activity” (of 05.06.2014 № 1314);
  • “On Standardization” (of 05.06.2014 № 1315);
  • “On Technical Regulations and Conformity Assessment” (of 15.01.2015 № 124);
  • “On Accreditation of Conformity Assessment Bodies” (of 17.05.2001 № 2407);
  • “On Market Surveillance and Control of Non-food Products” (of 02.10.2010 № 2735);
  • “On General Safety of Non-food Products” (of 02.12.2010 № 2736);
  • “On Amendments to Certain Legislative Acts of Ukraine Concerning the Implementation of Acts of Legislation of the European Union in the Field of Technical Regulation” (of 06.06.2019 № 2740), which entered into force on 03.07.2019;
  • “On Amendments to Certain Legislative Acts of Ukraine in Connection with the Adoption of the Law of Ukraine “On Standardization” (of 20.09.2019 № 124);
  • “On Amendments to Certain Legislative Acts of Ukraine Concerning the Reduction of Pressure on Business by Market Supervisors” (of 12.12.2019 № 367);
  • “On Ukraine's accession to the Metric Convention” (of 23.05.2018 № 2445);
  • “On Ukraine's accession to the Convention on Establishment of the International Organization of Legislative Metrology” (of 05.11.2020 № 998).
  • The Resolution of the Cabinet of Ministers of Ukraine on approval of the Procedure for providing free market consulting support to business entities on state market supervision (dated 12.02.2020 № 75), as provided for in paragraph 8 of the first part of Article 17 of the Law of Ukraine “On market surveillance and control of non-food products”.
  • Three technical regulations have been adopted in three priority sectors of industrial products (low-voltage electrical equipment, electromagnetic compatibility of equipment, machinery), which comply with the EU legislation.
  • All Lists of national standards, which are identical to the harmonized European standards, for the purposes of technical regulations were adopted
  • The infrastructure of designated conformity assessment bodies has been formed in priority sectors.
  • An independent national standardization body has been established, the functions of which are performed by the state enterprise “Ukrainian Scientific and Research and Training Center for Standardization, Certification and Quality Problems”.
  • An independent national accreditation body has been established, the functions of which are performed by the National Accreditation Agency of Ukraine.
  • Ukraine's accession to the Convention on Establishment of the International Organization of Legal Metrology (OIML) has been ensured. Ukraine is a Member State of the OIML since 03.04.2021.
  • Ukraine became an Associate Member of the European Association of National Metrological Institutes (EURAMET) since 2022.
  • Action Plan for the development of technical regulation system of Ukraine until 2025 was approved by the Resolution of the Cabinet of Ministers of Ukraine dated 22.09.2021 № 1145-p.
  • The Communicative Platform on Technical Regulation in Ukraine (techreg.in.ua) was created and a transparent dialogue and consultations with business and the interested public were established.

In order to determine the state of readiness of Ukraine's quality infrastructure for the conclusion of the ACAA Agreement the EU pre-assessment mission is being conducted since October, 2020.

As of today, the EU pre-assessment mission has assessed:

  • the state of adaptation of horizontal and vertical legislation of Ukraine's quality infrastructure to the EU legislation with a positive assessment from the European experts on the high degree of adaptation of Ukrainian legislation to the EU legislation (over 85%),
  • the standardization system with a positive assessment of Ukraine's implementation of the European experience in the field of standardization and the effectiveness of the European standardization system at the national level,
  • the metrology system of Ukraine,
  • the accreditation system of Ukraine,
  • the market surveillance system of Ukraine,
  • the conformity assessment system of Ukraine,
  • the field of machinery,
  • the field of electromagnetic compatibility of equipment,
  • the field of low-voltage electrical equipment.

The Ukrainian Side processes the recommendations of the European experts, provided on the basis of the results of assessment of the state of adaptation of Ukrainian legislation to the EU legislation, and ensures their taking into account.

The Ukrainian Side maintains constant communications with the European Side on the next steps for the conclusion of the ACAA Agreement in the first three priority sectors. 

Further actions in preparation for the conclusion of the ACAA Agreement.

  • Official assessment of the state of implementation of the recommendations of European experts by the Ukrainian side based on the results of all EU missions regarding Ukraine's readiness to conclude the ACAA Agreement.
  • The negotiation process regarding the procedure for concluding the ACAA Agreement and obtaining the Mandate for concluding the ACAA Agreement.
